Description

  • Manage the legal risk of the bank whilst maintaining commerciality, which includes, inter alia, instructions of bonds, authorizing payments, vetting documents and drafting guarantees. Perusing entity documents to establish locus standi of the entity entering into the contractual obligation.

Key Responsibilities

  • Provide a legal advisory and support service with regards to: Instalment sale agreements, Secured and unsecured loans, home loans, building bonds, commercial properties, commercial developments etc.
  • Instructing bonds to panel attorneys and managing the file until registration, including liaising with attorneys and managing queries, checking signed loan documents and ensuring all special conditions in the loan agreement are fulfilled prior to bond registration
  • Advising banking consultants on legal aspects of deal structure
  • Drafting nonstandard clauses for agreements
  • Vetting of documents and authorizing payments
  • Review credit minutes and ensure that all condition precedents on minutes are fulfilled, and security is perfected
  • Review property valuations and ensure that all valuation conditions are fulfilled

Qualifications, Experience and Skills

  • Bachelor of Law, Admitted Attorney and Conveyancer
  • 2 to 4 years conveyancing experience
  • Good general commercial law background and experience
  • Working knowledge of FICA and NCA
  • Experience in contract law and drafting of contracts
  • Banking experience and corporate legislation an advantage
